
NOTICE FROM CLASS COUNSEL of an IMPORTANT DEVELOPMENT in the SUNRISE PROPANE CLASS ACTION
This is notice of an important development in the Sunrise Propane class action.
As you are aware, we have decided not to sue the City of Toronto in our comprehensive action because we do not believe that we can succeed in an action against the City, as a matter of law. A number of class actions were initially issued after the explosions which did name the City of Toronto as a defendant. This was at a time when we were unclear about the facts and had not yet had an opportunity to review the law. Those actions have now been discontinued by Order of the Honourable Mr. Justice Cullity.
We have been asked by the Court to advise all potential class members that anyone wishing to bring his or her own action against the City of Toronto must do so on or before February 8, 2012 and if no action is brought by that date, potential class members will be prohibited from bringing an action against the City of Toronto.
PROPANE EXPLOSION LAWSUIT
Falconer Charney LLP has filed a proposed class action lawsuit in Toronto on behalf of Francesco Cugliari and Jan Anthony Thomas against Sunrise Propane Energy Group Inc. and the owner of the property, 2094528 Ontario Inc. Ted Charney and his litigation group have carriage of this matter.
A series of massive explosions took place on August 10, 2008 at a propane storage facility owned and operated by Sunrise Propane Industrial Gases located at Murray Road in North York. Storage tanks exploded and burned, sending a fire ball into the sky which residents could see for miles and which caused fear throughout the community.
The force of the explosion shattered windows, doors and shook buildings. Thousands of residents were asked by the police to evacuate. Noxious fumes from the burning propane escaped from the plant. The residue may have contaminated the land, impacting homeowners’ properties.
If you or a family member were affected by the explosion you may be entitled to compensation.
